Gjykata Supreme pritet t\u00eb vendos\u00eb brenda dy dit\u00ebve t\u00eb ardhshme p\u00ebr dy ankesat e paraqitura nga kandidat\u00ebt e Partis\u00eb Demokratike t\u00eb Kosov\u00ebs (PDK). P\u00ebrfundimi i k\u00ebtij procesi konsiderohet vendimtar p\u00ebr certifikimin e rezultateve p\u00ebrfundimtare t\u00eb zgjedhjeve parlamentare t\u00eb 7 qershorit dhe nisjen e procedurave p\u00ebr krijimin e institucioneve t\u00eb reja.<\/p>\n
Megjith\u00ebse nga Gjykata Supreme nuk kan\u00eb b\u00ebr\u00eb t\u00eb ditur n\u00ebse vendimi do t\u00eb merret para skadimit t\u00eb afatit ligjor, njoh\u00ebsit e proceseve zgjedhore vler\u00ebsojn\u00eb se, n\u00ebse nuk k\u00ebrkohet rinum\u00ebrim apo ndonj\u00eb veprim tjet\u00ebr nga Komisioni Qendror i Zgjedhjeve (KQZ), certifikimi i rezultateve mund t\u00eb b\u00ebhet deri n\u00eb fund t\u00eb k\u00ebsaj jave.<\/p>\n
Hulumtuesi i Institutit t\u00eb Kosov\u00ebs p\u00ebr Drejt\u00ebsi (IKD), Qemajl Marmullakaj, thot\u00eb se Gjykata Supreme nuk \u00ebsht\u00eb e obliguar ta shfryt\u00ebzoj\u00eb t\u00ebr\u00eb afatin ligjor p\u00ebr vendimmarrje.<\/p>\n
\u201cCertifikimi i rezultateve duhet t\u00eb ndodh\u00eb brenda afateve t\u00eb parapara ligjore. N\u00ebse Gjykata Supreme nxjerr vendimin ku nuk k\u00ebrkon veprime shtes\u00eb nga ana e KQZ-s\u00eb apo PZAP-s\u00eb, at\u00ebher\u00eb certifikimi i zgjedhjeve mund t\u00eb ndodh\u00eb brenda k\u00ebsaj periudhe kohore, deri n\u00eb fund t\u00eb jav\u00ebs. Jo domosdoshm\u00ebrisht Gjykata Supreme mund t\u00eb pres\u00eb deri n\u00eb afatin e parapar\u00eb ligjor dhe kjo mund t\u00eb shpie deri te nj\u00eb certifikim edhe m\u00eb i hersh\u00ebm i zgjedhjeve\u201d, deklaron ai p\u00ebr KosovaPress.<\/p>\n
Ai thekson se, pas certifikimit, nuk ekziston ndonj\u00eb penges\u00eb ligjore q\u00eb seanca konstituive e Kuvendit t\u00eb thirret menj\u00ebher\u00eb, pavar\u00ebsisht se Kushtetuta p\u00ebrcakton afatin maksimal prej 30 dit\u00ebsh.<\/p>\n
Sipas tij, krahas konstituimit t\u00eb legjislatur\u00ebs s\u00eb nj\u00ebmb\u00ebdhjet\u00eb, nuk ka ndonj\u00eb norm\u00eb q\u00eb thekson se deputet\u00ebt duhet t\u00eb zgjedhin presidentin para formimit t\u00eb qeveris\u00eb.<\/p>\n
\u201cAfatet jan\u00eb orientuese dhe jo detyrimisht duhet t\u00eb presim 30 dit\u00eb pas certifikimit t\u00eb zgjedhjeve p\u00ebr konstituimin e Kuvendit. Kjo duhet t\u00eb ndodh\u00eb menj\u00ebher\u00eb pas certifikimit t\u00eb zgjedhjeve, menj\u00ebher\u00eb u.d. e presidentes mund t\u00eb marr\u00eb veprime dhe t\u00eb th\u00ebrras\u00eb seanc\u00ebn konstituive t\u00eb Kuvendit. Pastaj jan\u00eb procedurat n\u00eb baz\u00eb t\u00eb Rregullores s\u00eb Kuvendit, ku pes\u00eb dit\u00eb para mbajtjes s\u00eb seanc\u00ebs konstituive kryetarja e Kuvendit t\u00eb legjislatur\u00ebs paraprake duhet t\u2019i mbledh\u00eb p\u00ebrfaq\u00ebsuesit e partive parlamentare q\u00eb t\u00eb p\u00ebrcaktojn\u00eb agjend\u00ebn e seanc\u00ebs konstituive t\u00eb Kuvendit. Sipas nenit 8 t\u00eb Rregullores s\u00eb Kuvendit, ky proces \u00ebsht\u00eb procedural dhe nuk mund t\u00eb tjet\u00ebrsohet nga ana e kryetarit t\u00eb Kuvendit t\u00eb kaluar. Seanca konstituive n\u00eb rend t\u00eb dit\u00ebs e ka formimin e komisionit t\u00eb p\u00ebrhersh\u00ebm p\u00ebr verifikimin e kuorumit dhe mandateve, betimin e deputet\u00ebve, zgjedhjen e kryetarit t\u00eb Kuvendit dhe zgjedhjen e n\u00ebnkryetar\u00ebve t\u00eb Kuvendit.
